I read this story today in the Star and to be quite honest, I am amazed. I can’t believe how far this has gone. Not only will the family most likely get money for Ramirez’s wrongful death, but now the deceased felon’s and apparent drug addict’s baby’s mom may even get an award.
I am somewhat bewildered. From all accounts, Robert Ramirez of Oxnard had been on the wrong path for a long time and could have died from a meth overdose. If the police hadn’t have intervened, Ramirez might have died from his own drug abuse and the family and his unborn son wouldn’t have gotten much more than social security. But Ramirez posed a threat to the general public, the officers used restraint that led to his death, and now everyone tied to Ramirez will most likely make a pretty penny off of his death. Even worse, officers may be more inclined now to let those overdosing on illegal substances run wild in the face of wrongful death lawsuits. And should they do just that for fear they will apply too much force in restraint, anyone hurt because of such a person will again be able to sue for the lack of intervention and officers failing to do their job. What a mess.
I recall in “It’s a Wonderful Life,” George Bailey came to a conclusion that everyone would have been better off had he never been born. His angel then reveals to Bailey just how bad things would have been had he never been born and thus rejuvenated his will to live and keep on fighting for the good.
Unfortunately, in the case of Ramirez…. the loss of his life is a cash cow for those around him.
It’s a sad state of affairs.
